The number

Up to 2 vehicles in 12 months, titled in your name

A Hawaii "dealer" includes any person or entity not expressly excluded who sells three or more vehicles within a calendar year, or who is engaged in the business of selling, soliciting, offering, or attempting to negotiate sales, purchases, or exchanges of motor vehicles.

What counts as dealing in Hawaii

A Hawaii "dealer" includes any person or entity not expressly excluded who sells three or more vehicles within a calendar year, or who is engaged in the business of selling, soliciting, offering, or attempting to negotiate sales, purchases, or exchanges of motor vehicles.

The count is only half the law. Whatever your number, three things turn a private seller into an unlicensed dealer in practice: buying vehicles mainly to resell them, advertising or holding yourself out as a seller, and selling vehicles that were never titled in your name. That last one — title jumping — is illegal on its own in nearly every state, at any count, and it is the violation unlicensed sellers are actually caught on.

The penalty for crossing the line

Fine of not more than $1,000, with each day's violation a separate offense (§ 437-35); acting as a dealer without a license is also a misdemeanor — fine of not more than $1,000, or imprisonment of not more than one year, or both (§ 437-35.5).
